Abstract
Law No. 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition have been implemented a decade since declared effective on March 5, 2000. Over a decade has many positive developments due to the implementation of Law No. 5 of 1999 for business competition in Indonesia. Business Competition Supervisory Commission (KPPU) has issued 128 decisions since 2000 until 2009. Although in the decision of KPPU sometimes contain controversy, but the development of business competition law shows a positive thing for the business world in Indonesia. In addition  to ensure a healthy and conducive competition, the Supreme Court issued  Supreme Court Regulation Number 1 of 2003 and was replaced by Supreme Court Regulation Number 3 of 2005 governing the procedures to object in the District Court to guarantee the rights of reported business actors in the District Court. Likewise KPPU has issued several guidelines to provide understanding and explanation of certain provisions of Law No. 5 of 1999. In this paper, will be elaborated the development of the implementation of Indonesian competition law for ten years.

Abstract
Law No. 5/1999 on Prohibition of Monopolistic Practices and Unfair Business Competition was introduced in March 1999 and taking into force one year later (2000). Prior to the adoption of this Law, there are legislations containing competition rules fragmented in numerous laws or regulations. This Law signifies the commitment and effort of Indonesian government to eradicate monopolistic practices or unfair business competition which is widely being practiced during 1970 – 1990’s. Since the promulgation of this Law, many controversies arise as to the background, title of the Law, content and wordings used in the Law, as well as the interpretation and application of the Law. Thus in this paper, we would like to denote problems found in the Law as well as our proposed recommendation to deal with. It is worthy to note that content or wordings (language) used in the Law may be incorrectly put or categorized. Therefore, interpretation and application of the Law shall be made in a thorough manner.

Abstract
The investment climate has an important meaning for both the investor and the country of investment destination. Laws and regulations governing all aspects of the direct investment, either in the context of formulation or implementation, should reflect both the risk and return level of investment. The acceptable risk and return level for investors are major determinants of the movement of investment flows from the home to host country, and are thus crucial in job creation and ultimately the level of economic development of the host country.

Abstract
In today's era of globalization, many countries adopt market economy system, including Indonesia, where more state role as regulator, which issue policies to regulate how economic activities run well and the competition took place in a healthy and conducive way. In this regard the state of Indonesia has issued a lot of industrial policies, trade and economy to encourage economic growth of Indonesia and at the same time improve the welfare of the community, such as the deregulation of trade policies and privatization of some State Own Enterprises. However, there are many industrial policies, trade and economy that are not consistent with competition policy. KPPU as business competition supervisory agency has provided advice and opinion concerning government policies that potentially inhibit competition. In this paper will be elaborated the need for harmonization of industrial policy, trade and economy with competition policy which in turn enhance community welfare.

Abstract
Peraturan Komisi Pengawas Persaingan Usaha (KPPU) Nomor 1 Tahun 2009 tentang Pra-Notifikasi Penggabungan, Peleburan, dan Pengambilalihan telah ditetapkan pada tanggal 13 Mei 2009. Keberadaan Peraturan Komisi ini disambut baik dalam rangka memberikan panduan yang jelas terkait dengan proses penggabungan, peleburan, dan atau pengambilalihan. Optimalisasi peraturan komisi dilakukan dengan memberikan komitmen kepada para pelaku usaha bahwa komisi tidak akan mengubah penilaiannya atas penggabungan, peleburan dan atau pengambilalihan yang telah dilakukan jika para pelaku usaha secara sukarela menyampaikan pra-notifikasinya kepada komisi. Permasalahan yang diangkat dalam tulisan ini adalah, pertama, bagaimana mengoptimalkan peraturan ini dalam rangka menjamin kepastian hukum kepada para pelaku usaha yang akan melaksanakan penggabungan, peleburan dan atau pengambilalihan, dan yang kedua, bagaimana prospek pengaturan penggabungan, peleburan dan atau pengambilalihan dengan menggunakan peraturan ini? Prospek pengaturan penggabungan, peleburan dan atau pengambilalihan adalah sangat baik dan prospektif karena dengan menggunakan peraturan komisi ini setiap penggabungan, peleburan dan atau pengambilalihan akan sesuai dengan semangat persaingan usaha yang sehat. Diharapkan bahwa implementasi peraturan komisi ini akan dapat menciptakan atmosfir baru dimana setiap penggabungan, peleburan dan atau pengambilalihan di Indonesia tidak akan mengurangi persaingan di pasar bersangkutan, tidak merugikan masyarakat, dan mempunyai spirit persaingan usaha yang sehat.

Abstract
This paper tries to seek the role of economic analysis in competition law in terms of its rationality and in practical sense. The role of economic analysis was described and identified in each stage of case investigations. The primary role of economic analysis is to determine or predict the impact of strategic behavior conducted by firms. Thus, antitrust authority will use economic analysis to evaluate the incentives and the ability of firms in engages into certain strategic behavior. Using one of KPPU’s case in 2007 (Temasek case), this paper illustrating the use of economic analysis and debate that might arise from that economic analysis.

Abstract
Pembahasan terkait perlindungan kearifan tradisional (traditional knowledge) dalam masalah hak paten di tingkat internasional telah dan sedang dilakukan diberbagai forum. Baik di dalam forum yang terkait dengan perdagangan seperti World Trade Organization (WTO) maupun yang terkait dengan perlindungan lingkungan seperti forum Konvesi tentang Keanekaragaman Hayati (Convention on Biological Diversity) dan Konvensi PBB tentang Perubahan Iklim (United Nation Framework on Climate Change). Hingga saat ini belum terdapat kesepakatan yang final dan tertuang dalam suatu instrumen yang mengikat untuk menjadi dasar perlindungan kearifan tradisional. Perdebatan terjadi antara negara maju di satu sisi dengan negara berkembang di sisi lainnya yang merasa dirugikan dengan tidak adanya perlindungan tersebut. Indonesia merupakan salah satu dari kelompok negara berkembang yang telah dan akan banyak dirugikan dengan ketiadaan perlindungan tersebut. Salah satu proposal yang ditawarkan oleh negara berkembang adalah adanya kewajiban untuk memperoleh ‘Persetujuan berdasarkan pengetahuan sebelumnya’ (Prior Inform Consent) untuk dapat memperoleh hak paten yang memiliki unsur kearifan tradisional. Hal ini akan dielaborasi dalam tulisan ini.

Abstract
Dari perspektif internasional, Indonesia telah meratifikasi Konvensi Hak Anak (KHA/CRC)). Oleh karena itu,  Indonesia mempunyai kewajiban untuk melindungi Hak Anak. Namun dalam kenyataannya, walaupun Undang-Undang Dasar dan beberapa perundang-undangan ditetapkan untuk memberikan perlindungan terhadap anak Indonesia, namun implementasi perlindungan terhadap hak anak di Indonesia masih belum memadai. Hampir 20 tahun sejak Indonesia meratifikasi Konvensi Hak Anak dan sekian lama berlakunya Undang-Undang No.23 tahun 2002 tentang Perlindungan Anak,  pelanggaran hak anak terus-menerus dapat dilihat dalam pemberitaan mass media, anak-anak jalanan terlihat dimana-mana. Tulisan ini akan mengelaborasi, apa pengaruh Rule of Law di Indonesia terhadap generasi penerus cita-cita perjuangan bangsa yang di dalam UU Perlindungan Anak dinyatakan memiliki ‘peran strategis dan mempunyai ciri dan sifat khusus yang menjamin kelangsungan eksistensi bangsa dan Negara Republik Indonesia pada masa depan’?

Kedudukan Perjanjian Yang Berbahasa Asing Pasca Berlakunya UU No. 24 Tahun 2009

Abstract
The promulgation of Law No. 24 of 2009 on the National Flag, Coat of Arms,  Language and Anthem on July 9, 2009 has led to differences of interpretation among users, legal observers and the public, particularly against the provisions of Article 31 paragraph (1). Some people argue that international agreements which are not made by using Indonesian Language (Bahasa Indonesia) may cause the agreement null and void by law. Some argue the agreement remains effective, but that particular reason may be the basis for the request of cancellation in the future if one party is to realize his lack of understanding with the clause contained in the agreement. Being aware of the lack of understanding is interpreted as a form of oversight. Judges as parties who try and resolve the matter are expected to be wise so that the decision given will be far from an  impression against the interests of other nations who have a good faith, chauvinistic which will eventually lead to retaliation / reciprocity.
